WHASOLS SMC-LTD (“WHASOLS,” “we,” “us”) respects and values your privacy. This Privacy Policy explains what information we collect about you when you use the WHASOLS Marketplace, and how we use, store and disclose it, so you can make an informed decision about sharing your information with us.
Capitalized terms in this Privacy Policy have the meaning given to them in our Terms of Service. This Privacy Policy supplements, but does not replace, our Terms of Service or the policies of Vendors whose Products are offered through the Marketplace — those Vendors have their own privacy policies, which may differ from ours.
We may revise this Privacy Policy from time to time. If we do, we will update the “Last Updated” date below. By continuing to use the WHASOLS Marketplace after an update, you acknowledge that you have read and understood the revised policy.
We collect information you send us directly — by registering a developer account, filling out a form, or corresponding with us by email or support ticket. We also collect information automatically as you browse the Marketplace and use our services, as described below.
Personal information means any information relating to an identified or identifiable natural person — someone who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, or an online identifier.
We may collect: your name, email address, postal address, telephone number, IP address, browser and operating system information, screen resolution, which pages you view on the Marketplace and when, domain name, and — for developer accounts — group/company name, website URL, and similar contact details for technical, marketing or billing contacts within your organization. We do not process card or bank payment details ourselves; those are handled by your WHASOLS account’s own billing system.
If you communicate with us — by email, support ticket, review, comment or any other submission — we may collect information relating to that communication.
We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may use, transfer and disclose non-personal information for any purpose.
We do not knowingly collect Personal Information about children under the age of 13. If we become aware that we have inadvertently collected such information, we will take steps to delete it as soon as possible, except where we are required by Applicable Law to keep it. Where we know a user is a minor under Applicable Law, we will obtain parental or guardian consent before using that user’s Personal Information.
We use Personal Information to create and authenticate your account, to process the specific request you made when you gave it to us, to provide customer and technical support, and to communicate with you about your account and our services.
If you sign up for a newsletter or mailing list, we use your Personal Information to send it — you can opt out at any time from your account settings. WHASOLS SMC-LTD is registered in Pakistan. Your Personal Information may be stored on servers located in Pakistan or in other countries where our infrastructure or service providers operate. By using the Marketplace, you consent to this transfer and storage. We do not share your Personal Information with unaffiliated third parties except as described in this Privacy Policy, and we will never disclose it to an unaffiliated third party for email or other marketing purposes without your consent first.
We are not responsible for protecting information you choose to share in publicly available areas of the Marketplace, such as reviews or comments — use your own judgment before posting there.
If WHASOLS is acquired by, merges with, or has substantially all of its assets purchased by another company, your Personal Information may be shared with that company; we will notify you in accordance with the notice provisions of our Terms of Service.
We may disclose Personal Information where required by Applicable Law, a court order, or another lawful governmental request, or where we determine disclosure is necessary to protect our rights, to investigate suspected fraud or abuse, or to protect the safety of any person. We take reasonable technical and organizational steps to protect the Personal Information we collect about you. No security measure is foolproof, and we cannot guarantee absolute security, only that we take reasonable steps to protect it. If we become aware of a security breach or unauthorized disclosure concerning your information, we will notify you in accordance with the notice provisions of our Terms of Service. You are responsible for maintaining the security of your own account credentials.
Where you register as a developer or publish a Product on the Marketplace, we may process End User Data on your behalf in connection with operating the Marketplace — for example, storing reviews, comments, or download activity relating to your listing. This section describes how we handle that data.
We use subprocessors — such as hosting, email delivery, and analytics providers — to help us operate the Marketplace. We take reasonable steps to ensure any subprocessor we engage is bound to protect Personal Information to a standard consistent with this Privacy Policy. If you have a data-protection concern about a specific subprocessor, contact us via our support contact page and we will consider it in good faith.
If we become aware of a security incident — any accidental or unlawful destruction, loss, alteration, or unauthorized disclosure of or access to your Personal Information — we will notify affected users without undue delay, and in any event within 72 hours of becoming aware of it, describing the nature of the incident and the steps we are taking in response.
If your developer account is terminated, we will, within 90 days and at your election, either securely delete the Personal Information we processed on your behalf or, where reasonably feasible, make a copy available to you before deletion — except to the extent we are required by Applicable Law to retain it, in which case we will retain it only for as long as required and for no other purpose.
Upon your reasonable request, we will make available information reasonably necessary to demonstrate our compliance with this section. Where a formal audit or inspection is requested, we will accommodate it no more than once per year (unless required sooner by a regulatory authority), during business hours, and in a manner that minimizes disruption to our operations.
Because WHASOLS SMC-LTD is registered in Pakistan, this Privacy Policy and your rights over your Personal Information are governed primarily by the laws of the Islamic Republic of Pakistan, including applicable data-protection legislation in force from time to time. Where Applicable Law grants you specific rights — such as the right to know what Personal Information we hold about you, to request correction of inaccurate information, or to request deletion of information we no longer need — you may exercise those rights by contacting us using the details below, and we will respond in accordance with Applicable Law.
